Release and Waiver of Liability

Please read this waiver carefully. By purchasing, consuming, or participating in any activity involving products from WTF Hot Snacks, you acknowledge that you have read, understood, and voluntarily agree to the terms of this Release and Waiver of Liability.

1. Assumption of Risk

I, the undersigned ("Participant"), hereby acknowledge and agree that I am fully aware of the nature of WTF Hot Snacks products and the potential risks associated with consuming food items containing extreme levels of capsaicin (the active component in chili peppers). I understand that these risks may include, but are not limited to:

• Intense burning sensation in the mouth, throat, and stomach.
• Gastrointestinal distress, including stomach pain, cramping, nausea, vomiting, and diarrhea.
• Sweating, flushing, shortness of breath, and increased heart rate.
• Watery eyes, runny nose, and temporary loss of speech.
• Aggravation of pre-existing medical conditions (e.g., asthma, GERD, heart conditions, allergies).
• Allergic reactions, which may in rare cases be severe or life-threatening.
• Contact irritation to skin or eyes if products are mishandled.

I voluntarily and knowingly assume all such risks, known and unknown, even if arising from the negligence of WTF Hot Snacks or others, and assume full responsibility for my participation and consumption.

2. Release and Waiver of Claims

In consideration for being permitted to purchase and/or consume WTF Hot Snacks products, I, for myself and on behalf of my heirs, assigns, personal representatives, and next of kin, hereby RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE WTF Hot Snacks, its owners, officers, employees, agents, affiliates, and representatives (collectively, the "Releasees") from any and all liability, claims, demands, actions, and causes of action whatsoever, direct or indirect, arising out of or related to any loss, damage, or injury, including death, that may be sustained by me, or to any property belonging to me, WHETHER CAUSED BY THE NEGLIGENCE OF THE RELEASEES or otherwise, while participating in such activity, or while in, on or upon the premises where the activity is being conducted.

3. Indemnification

I agree to INDEMNIFY AND HOLD HARMLESS the Releasees from any loss, liability, damage, or costs, including court costs and attorney fees, that they may incur due to my participation in consuming WTF Hot Snacks products, whether caused by my negligence or otherwise. This includes any claims brought by third parties to whom I may have provided or shared WTF Hot Snacks products.

4. No Medical Advice / Personal Responsibility

I acknowledge that WTF Hot Snacks and its representatives are not medical professionals and are not providing medical advice. I am responsible for consulting with a physician if I have any concerns about my health or suitability for consuming extremely spicy foods. I represent that I am in good health and have no medical conditions that would be aggravated by consuming such products, or I have consulted with a physician who has approved my consumption.

I agree to use caution and common sense when handling and consuming these products. I will not provide these products to individuals who are unaware of their extreme nature, minors, or individuals with health conditions that may be adversely affected.

5. Acknowledgement of Understanding

I HAVE READ THIS RELEASE AND WAIVER OF LIABILITY, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY AGREEING TO IT (IMPLIED BY PURCHASE/CONSUMPTION), AND AGREE TO IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.

By purchasing, possessing, gifting, consuming, or otherwise interacting with WTF Hot Snacks products, you signify your acceptance of this waiver. If you do not agree to these terms, do not purchase or consume our products.
